Terms of Use

1. Parties and scope

These terms govern use between BrainyTech, which builds Kidlio, and the person visiting this site. The Kidlio mobile app is not released yet. Today this is a marketing site: nothing is sold here, no membership is taken, no subscription starts and no payment is collected. Some clauses below (trial, subscription, right of withdrawal) will take effect when the app reaches the stores; this text will be renewed that day.

2. What the service is — and is not

Kidlio is a tool for parents and carers of children aged 0–10 that suggests screen-free activities. Activities are for education and fun.

Kidlio is not a screening, measurement or diagnostic tool. The development tracking in the app is a summary of the activities you did together with your child; it is not a developmental assessment, a diagnosis or a clinical measure, and it does not replace the opinion of a physician, child development specialist, psychologist or other expert. If you have a concern about your child's development, health or sleep, please consult a professional.

3. Child safety and adult supervision

Activities are suggestions. As the only person who knows your child's age, developmental stage, health, allergies and your surroundings, you decide which activity is suitable. Stated age ranges are general guidance, not a substitute for judging suitability yourself.

Every activity is designed to be carried out with an adult present and supervising without interruption. Do not leave your child alone during an activity. Check every material for age-appropriateness yourself before you begin. In particular:

• Balloons, marbles, beads, buttons, batteries and similar small parts are a choking hazard and must be kept away from young children.
• Sharp and pointed tools such as scissors, knives and needles must be used only by an adult, or under direct adult supervision.
• Steps involving hot water, stovetops, ovens, candles or fire must be carried out by an adult only.
• In any activity involving water — including a bathtub, a basin or a pool, and even a small amount of water — a child must never be left alone, not for a moment.
• String, cord and plastic bags carry entanglement and suffocation risks.
• For activities involving food, check your child's allergies beforehand.

Choosing, preparing and carrying out activities, and supervising the child throughout, is the responsibility of the parent or supervising adult.

If you believe an activity is unsafe, incomplete or unsuitable for its age group, tell us at contact@brainytech.net; we review every report and, where needed, correct or withdraw the activity without delay.

4. Limits of liability — and your rights that stay

BrainyTech cannot be held liable for harm arising from activities carried out contrary to these terms and to the warnings in the activity descriptions, without adult supervision, or in a manner unsuited to the child's age.

This limitation does not cover liability arising from BrainyTech's own intent or gross negligence. Under Article 115 of the Turkish Code of Obligations, an agreement made in advance to exclude liability for intent or gross negligence is null and void. Likewise, liability for death and personal injury, and your rights under Turkish Consumer Protection Law no. 6502, are not limited in any way. No provision of this text may be read as removing or narrowing a consumer's mandatory statutory rights.

5. The waiting list and the email we will send

If you leave your email on the waiting list, we send you exactly one email: on the day Kidlio reaches the stores, with the list-only discount link inside. No newsletters, campaigns or announcements in between. You can withdraw your consent at any time through the link in that message or by writing to contact@brainytech.net; your record is deleted when you do.

6. Activity ideas you send us

When you send us an activity idea through the suggestion form:

• You confirm that the content is yours and does not infringe anyone else's rights.
• You keep the rights to your idea. You grant us a non-exclusive, royalty-free and indefinite permission to review, edit, adapt and use it within Kidlio content. No fee or royalty is payable in return.
• We are not obliged to use, publish or reply to a submitted idea, and you accept that similar ideas may have been developed independently by us.
• If your idea is published, your name is credited only if you separately agree; otherwise it is used anonymously.
• Please do not include personal details about yourself, your child or anyone else in the suggestion text.

7. Free use, trial and subscription

Kidlio will have a free tier, and using it will not require a credit card or any other payment method. The scope of the free tier (how much content, which features) may change over time; before any material change we will give notice in the app and by email.

The paid Kidlio+ subscription will be managed through the relevant store (App Store / Google Play) once the app is published. Prices and campaigns announced on this site are promotional and do not constitute a binding offer of sale; when sales open, the applicable price, billing period, renewal and cancellation terms and your right of withdrawal will be presented separately on the purchase screen. No payment is collected through this site today.

8. Content and intellectual property

The texts, activity descriptions, images, brand name and software elements on this site and in the Kidlio app are protected by intellectual property rights. Other than personal, non-commercial use, they may not be copied, reproduced, distributed or made the subject of derivative works without permission.

9. Unacceptable use

• Overloading the site or its infrastructure with automated tools, attempting to bypass security measures, or attempting unauthorised access.
• Filling the forms with untrue, misleading, abusive or hateful content, or content that infringes the rights of others.
• Bulk-scraping or republishing site content without permission.

We reserve the right to restrict access technically in case of such use.

10. Changes to these terms

When these terms change, the update date at the top of the page changes with them. When the app reaches the stores, this text will be rewritten, and subscription, withdrawal and refund terms will enter it in full that day.

11. Governing law and how to raise a dispute

Turkish law applies to these terms. If you are acting as a consumer, you may apply — depending on the monetary thresholds — to the Consumer Arbitration Committee or the Consumer Court where you live. If you are resident in the European Union, the mandatory protections of your country's consumer law are reserved. In case of any conflict between the Turkish and English versions of this text, the Turkish version prevails.
